CapSend Terms of Service

These Terms of Service (the “Terms”) govern CapSend. CapSend is operated from California, United States. By installing, purchasing, or using it, you agree to these Terms. If you act for an organization, you confirm that you can accept them for it.

1. CapSend and Third-Party AI Services

CapSend is an independent browser productivity tool, not an AI model or service. Capture + Voice lets you capture selected webpage content and prepare a typed or browser-transcribed prompt; Voice Only works without a screenshot. CapSend prepares your selected content in a supported AI provider’s composer and leaves it unsent for your review and manual submission. It does not generate, evaluate, retrieve, or store AI responses.

Supported destinations include ChatGPT / OpenAI, Claude / Anthropic, Gemini / Google, Grok / xAI, and Microsoft Copilot. They are independent third parties that CapSend does not operate or control. Their names and trademarks belong to their owners. Inclusion does not imply sponsorship, endorsement, authorization, affiliation, or partnership.

You may need a separate provider account and must follow its terms and policies. Providers control their output, moderation, availability, account restrictions, and data practices. Their interfaces may change, so permanent compatibility is not guaranteed. AI output may be inaccurate, unsafe, incomplete, or unsuitable; evaluate it before relying on it, especially for important decisions.

2. Free Trial

CapSend offers one free trial per user with 15 successful handoffs shared between Capture + Voice and Voice Only. Failed or unconfirmed handoffs do not count. Purchase restoration does not create or reset another trial.

CapSend may use reasonable available information to determine eligibility and prevent repeated or abusive trials. Deliberately circumventing trial limits is prohibited.

3. Subscription, Cancellation, Restoration, and Refunds

CapSend Unlimited costs $4.99 USD per month, plus applicable taxes, and renews automatically until canceled. Stripe processes payments under its own terms and privacy practices.

You may cancel at any time. Cancellation prevents future renewal, while access ordinarily continues through the paid-through period without an automatic prorated refund. Temporary payment recovery may not immediately end access, but access ends when the subscription becomes ineligible.

CapSend may change its price. Existing subscribers will receive reasonable advance notice before a price change affects a future renewal, subject to applicable law. The $4.99 price is not guaranteed for life.

Purchase restoration reconnects an existing subscription to a fresh or reinstalled CapSend installation without creating another charge, subscription, or trial. A CapSend subscription currently supports one active installation at a time, so restoring access on a new installation may revoke access on the previous installation. Maintain access to your subscription’s billing email.

Payments are generally non-refundable except where required by law. CapSend may consider refunds or credits for duplicate charges, billing errors, or exceptional circumstances. Contact [email protected] without including full card details. Refunds, disputes, or chargebacks may affect access where legally permitted.

4. Your Content and Acceptable Use

You retain ownership of your screenshots, prompts, and other content. You give CapSend only the limited permission needed to process it in your browser and provide the requested functionality. During normal use, screenshots and prompts are not uploaded to CapSend’s backend.

You are responsible for choosing and reviewing content, having the necessary rights and permissions, and following applicable law and provider rules. A third-party provider independently governs content submitted to it.

You may not use CapSend for illegal activity or infringement; violate applicable provider terms; deliberately bypass trial, subscription, credential, recovery, security, or rate-limit controls; share credentials or seek unauthorized access; attack or interfere with CapSend; conduct automated or bulk abuse; circumvent security; or reverse engineer CapSend except where that restriction is legally unenforceable.

5. CapSend Intellectual Property

CapSend owns or licenses its software, name, logo and orb, interface, site and visual assets, documentation, and other service content. You receive a limited, non-transferable right to use CapSend for its intended purpose under these Terms. Third-party names and trademarks remain their owners’ property.

6. Changes, Availability, Suspension, and Ending Service

CapSend may change or remove features or provider support for compatibility, security, maintenance, provider changes, or business reasons. Uninterrupted, error-free service and permanent provider compatibility are not guaranteed. Temporary outages generally do not create refund rights except where required by law.

CapSend may suspend or terminate access for fraud, abuse, attacks, illegal use, security threats, credential sharing, deliberate circumvention, or serious or repeated Terms violations. Where reasonable, ordinary issues may be resolved before suspension; serious threats may require immediate action. Access may be restored when resolved. Serious violations do not guarantee a refund except where required by law.

If CapSend permanently discontinues the entire paid service, future recurring charges will stop and remaining prepaid time will be handled fairly through continued access where reasonably possible or an appropriate refund or credit. Uninstalling the extension does not itself cancel a subscription.

7. Disclaimers, Liability, and Limited Indemnification

To the extent permitted by law, CapSend is provided “as is” and “as available.” CapSend does not promise uninterrupted or error-free operation, permanent provider compatibility, or the accuracy, safety, legality, completeness, usefulness, or suitability of third-party AI output.

To the extent permitted by law, CapSend is not liable for indirect, incidental, special, consequential, exemplary, or similar damages. Its total monetary liability will generally not exceed the fees you paid CapSend during the preceding 12 months.

To the extent permitted by law, you agree to cover reasonable losses CapSend incurs from third-party claims caused directly by your unlawful content, infringement of another’s rights, deliberate misuse of CapSend, or serious violation of these Terms. This does not apply to the extent a claim results from CapSend’s own conduct. Non-waivable rights, remedies, and liabilities remain protected.

8. Privacy

The CapSend Privacy Policy explains how CapSend handles information and is incorporated into these Terms.

9. Disputes and California Law

California law governs these Terms, subject to mandatory consumer protections. Before filing a formal dispute, you and CapSend will attempt good-faith informal resolution for 30 days. Send notice describing the issue and requested resolution to [email protected].

If unresolved, either party may proceed in an appropriate California court or qualifying small-claims court. These Terms do not require mandatory arbitration, waive class-action participation, or waive non-waivable consumer rights.

10. Changes and General Terms

CapSend may update these Terms as the service or applicable requirements change. Existing subscribers will receive reasonable notice of material changes where required or appropriate. Continued use may constitute acceptance to the extent permitted by law.

If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver. These Terms and the incorporated Privacy Policy form the agreement concerning CapSend, except for additional terms expressly presented and accepted for a specific feature or transaction.
